1. Agreement to Terms

By accessing or using Driftcheck (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part, you may not use the Service.

2. Description of Service

Driftcheck is a design quality assurance tool that:

• Compares live website implementations against Figma designs
• Identifies visual drift, accessibility issues, and UX problems
• Generates automated audit reports using AI analysis
• Integrates with Figma, Jira, Slack, and Microsoft Teams

3. Acceptable Use Policy

3.1 Permitted Use

You may use Driftcheck to:

• Audit websites you own or have explicit permission to audit
• Compare your own Figma designs against your implementations
• Generate reports for internal quality assurance purposes

3.2 Prohibited Use

You may not:

• Audit websites without permission from the owner
• Use the Service to scrape, copy, or steal competitor designs
• Attempt to reverse engineer, hack, or bypass security measures
• Use the Service for illegal purposes or to violate intellectual property rights
• Share your account credentials with others
• Upload malicious content, viruses, or harmful code
• Abuse rate limits or attempt to overload our infrastructure
• Use the Service to harass, stalk, or harm others
• Resell or redistribute the Service without authorization

3.3 Enforcement

We reserve the right to:

• Suspend or terminate accounts violating these Terms
• Remove content that violates acceptable use
• Report illegal activity to authorities
• Refuse service to anyone for any reason

4. User Accounts

4.1 Registration

• You must provide accurate information
• You must be at least 13 years old
• You are responsible for maintaining account security
• You must notify us immediately of unauthorized access

4.2 Account Termination

• You may delete your account at any time via Settings
• We may terminate accounts for Terms violations
• Upon termination, your data will be deleted per our Privacy Policy

5. Subscription Plans and Billing

5.1 Plans

• Free — Limited checks per month (as specified on pricing page)
• Pro — $19/month · unlimited checks, additional features
• Team — $49/month · multiple users, team collaboration features

5.2 Billing

• Subscriptions billed monthly via Stripe
• Auto-renewal unless cancelled
• Prices subject to change with 30 days notice
• No refunds for partial months

5.3 Cancellation

• Cancel anytime via Settings → Billing
• Access continues until end of billing period
• No prorated refunds
• Resubscribe anytime at current pricing

5.4 Payment Failures

• Failed payments may result in service suspension
• We'll notify you before suspension
• Account deleted after 60 days of non-payment

6. Intellectual Property

6.1 Our Property

• Driftcheck name, logo, and branding are our property
• The Service code, design, and features are protected by copyright
• You may not copy, modify, or create derivative works without permission

6.2 Your Content

• You retain ownership of URLs, Figma files, and data you submit
• You grant us a license to process your content to provide the Service
• This license ends when you delete content or close your account

6.3 User Responsibility

• You represent that you have rights to all content you submit
• You will not submit copyrighted or trademarked content without permission
• You indemnify us against claims arising from your content

7. AI-Generated Analysis Disclaimer

7.1 Automated Tool

• Not Human Review — Analysis is automated, not performed by design experts
• Potential Errors — AI may produce false positives or miss issues
• No Guarantee — We don't guarantee accuracy, completeness, or correctness
• Suggestions Only — Results are suggestions, not professional advice

7.2 Your Responsibility

• Verify Results — Always verify AI findings before taking action
• Professional Review — Consult qualified professionals for critical decisions
• No Liability — We are not liable for decisions based on automated analysis

8. Third-Party Services

8.1 Integrations

Driftcheck integrates with:

• Figma — Subject to Figma's Terms of Service
• Stripe — Subject to Stripe's Terms of Service
• Jira, Slack, Teams — Subject to respective vendor terms

8.2 No Endorsement

• We don't control or endorse third-party services
• We're not responsible for their availability or changes
• Integration issues are handled on a best-effort basis

9. Data and Privacy

Your use is subject to our Privacy Policy. We collect and process data as described in the Privacy Policy. You consent to data processing when using the Service.

10. Limitation of Liability

10.1 Service Provided “As Is”

• No warranties of any kind, express or implied
• No guarantee of uptime, accuracy, or fitness for purpose
• Use at your own risk

10.2 Damages

We are not liable for:

• Lost profits, data, or business opportunities
• Indirect, incidental, consequential, or punitive damages
• Decisions made based on automated analysis
• Third-party service failures or integration issues
• Security breaches despite reasonable precautions
• Damages exceeding amount paid in past 12 months

10.3 Exceptions

Some jurisdictions don't allow liability limitations. In those cases, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your violation of these Terms
• Your violation of third-party rights
• Your misuse of the Service
• Content you submit to the Service

12. Dispute Resolution

12.1 Informal Resolution

Contact legal@driftcheck.app to resolve disputes informally first.

12.2 Arbitration Agreement

If informal resolution fails:

• Disputes resolved through binding arbitration (not court)
• Arbitration conducted under AAA rules
• One arbitrator, decision is final
• No class actions or jury trials

12.3 Exceptions

Small claims court and injunctive relief claims exempt from arbitration.

12.4 Governing Law

These Terms are governed by applicable law without conflict-of-law provisions.

13. Service Modifications

We may:

• Modify features, pricing, or availability at any time
• Temporarily suspend the Service for maintenance
• Discontinue the Service with 30 days notice

We'll notify you of material changes via email or in-app notice.

14. Entire Agreement

These Terms, our Privacy Policy, and pricing page constitute the entire agreement between you and Driftcheck.

15. Severability

If any provision is found unenforceable, the rest remains in effect.

16. Waiver

Failure to enforce any provision doesn't waive our right to enforce it later.

17. Assignment

You may not assign these Terms. We may assign to affiliates or acquirers.
